EVChargeLK Terms of Use

EVChargeLK provides a digital charging-point discovery and trip-planning service. The Services may include a charging-station directory, map display, nearest-charger search, route planning, charging-stop recommendations, saved trips, station information, subscription features and, in future, booking or payment functionality.

EVChargeLK is a locator and information platform. Unless expressly stated otherwise, EVChargeLK does not own, operate, maintain or control third-party charging stations. Station availability, operating hours, connector availability, pricing, charging speed, queues and other information may change and may be supplied by station operators or other sources. You should verify critical information with the station before travelling or charging.

Route and charging recommendations are estimates generated from available map, station and vehicle information. They are not a guarantee that a vehicle will reach a charger. Actual range may vary due to speed, traffic, weather, terrain, battery condition, load, driving style and use of heating or air-conditioning.

Do not operate the app, enter destinations, read detailed information or interact with the device in a way that distracts you while driving. Follow road rules and use appropriate hands-free navigation. EVChargeLK does not replace the driver’s judgement, vehicle manufacturer instructions, road signs or emergency services.

Map and routing functionality may be provided through Google Maps Platform or other providers. You agree that use of map functionality is also subject to the applicable third-party terms, including Google’s applicable Maps/Google Earth Additional Terms where Google Maps is used.

You must provide accurate information and keep your login credentials secure. You are responsible for activity occurring through your account unless caused by our failure to apply reasonable security measures.

Certain features may require a paid subscription. Subscription prices, billing periods, renewal terms and included features will be displayed before purchase. Additional Subscription Terms form part of these Terms.

Where a subscription is purchased through Apple App Store or Google Play, payment is processed by the relevant platform and the platform’s billing, cancellation and refund mechanisms apply in addition to these Terms. Where we later support direct web payments, the checkout terms displayed at purchase will apply.

If you submit station reviews, corrections, photographs or other content, you must have the right to submit it and must not submit unlawful, misleading, defamatory, infringing, abusive or malicious content. You grant EVChargeLK a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and use that content for operating and improving the Services.

Attempting to access another user’s account or our systems without authorization.

Scraping, bulk copying, reselling or redistributing our proprietary station database or non-public data without written permission.

Interfering with the security, integrity or availability of the Services.

Using the Services for unlawful, fraudulent or unsafe purposes.

Submitting false station information with intent to mislead users.

The EVChargeLK name, branding, software, interface, original content, database structure and related intellectual property are owned by or licensed to EV CHARGE LK (PVT) LTD, except third-party content and marks. No rights are granted except those expressly stated in these Terms.

We may modify, suspend or discontinue features, including station data sources, map providers or subscription benefits, where reasonably necessary. We will provide notices where required by law or where a material change affects a paid service.

To the maximum extent permitted by applicable law, the Services are provided on an “as available” basis. We do not guarantee uninterrupted availability, absolute accuracy of station data, continuous charger availability, successful charging, exact range, exact travel time or the suitability of a route for every vehicle.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to applicable law, EVChargeLK is not responsible for losses arising from inaccurate third-party station information, charger outages, road conditions, traffic, vehicle condition, user failure to follow navigation or safety instructions, or third-party services.

We may suspend or terminate accounts for material breach, fraud, abuse, security risks or unlawful use. You may stop using the Services and request account deletion. Subscription cancellation is governed by the Subscription and Cancellation Policies.

You consent to receiving service-related notices electronically, including by email, in-app notification or other electronic means. Electronic records and electronic contracts may have legal effect under the Electronic Transactions Act, No. 19 of 2006 as amended.

These Terms are governed by the laws of Sri Lanka, subject to any mandatory consumer rights that cannot lawfully be excluded. Before commencing formal proceedings, users are encouraged to contact us at info@evchargingpoint.lk so that we can attempt to resolve the complaint.
